Plaintiffs filed suit seeking to hold the Palestinian Authority vicariously liable for an attack of a holy site in the West Bank by an armed gunman. The court rejected plaintiffs' claim that the Fifth Amendment's Due Process Clause imposes personal jurisdiction restrictions that are less protective of defendants than those imposed by the Fourteenth Amendment, explaining that precedent foreclosed this claim. Therefore, the court concluded that plaintiffs failed to carry their burden of demonstrating that personal jurisdiction over the Palestinian Authority in this case would meet the requirements of the Fifth Amendment's Due Process Clause. Accordingly, the court affirmed the district court's denial of plaintiffs' motions for jurisdictional discovery and its grant of the Palestinian Authority's motions to dismiss for lack of personal jurisdiction. Plaintiff filed suit against Ethiopia, alleging violation of the Wiretap Act, 18 U.S.C. 2510 et seq., and the Maryland common law tort of intrusion upon seclusion. Plaintiff alleged that he was tricked into downloading a computer program that allegedly enabled Ethiopia to spy on him from abroad. The district court dismissed the suit. The court concluded that the Foreign Sovereign Immunities Act (FSIA), 28 U.S.C. 1604, withdraws jurisdiction in toto. The court affirmed the district court's dismissal of plaintiff's intrusion-upon-seclusion claim for lack of subject matter jurisdiction. TGS, a Houston company requested seismic data from Geophysical, a Canadian company, under Canada's law that requires companies who gather seismic data about the Earth's substructure to submit their findings to the Canadian government. After a period of confidentiality, the Canadian agency that compiled this data was then apparently permitted to release it to members of the public upon specific request. Geophysicial then filed suit against TGS, alleging copyright infringement. The court held that the act of state doctrine does not forbid a United States court from considering the applicability of copyright's first sale doctrine to foreign-made copies when the foreign copier was a government agency. The court also held that the inapplicability of the Copyright Act, 17 U.S.C. 101 et seq., to extraterritorial conduct barred a contributory infringement claim based on the domestic authorization of entirely extraterritorial conduct. In 1963, the Republic of Guinea entered into an agreement with Halco establishing the Compagnie des Bauxites de Guinée (CBG) for the purpose of developing Guinea's rich bauxite mines. Nanko filed suit against Alcoa, alleging breach of the CBG Agreement, asserting that it was a third-party beneficiary thereof, and another for racial discrimination in violation of 42 U.S.C.1981. Nanko later added Halco as a defendant and asserted an additional claim against Alcoa for tortious interference with contractual relations. The district court dismissed the case under Rule 12(b)(7) for failure to join Guinea as a required Rule 19 party. The court concluded that the district court's Rule 19 holding failed to fully grapple with Nanko's allegations and that those allegations, accepted as true, state a claim for racial discrimination under section 1981. The court reasoned that, insofar as the existing parties' interests are concerned, evidence of Guinea's actions, views, or prerogatives can be discovered and introduced where relevant to the parties' claims and defenses even if Guinea remained a nonparty. At this stage in the pleadings, the court did not believe that the allegations could be reasonably read to show that Guinea was a necessary party. Accordingly, the court reversed and remanded. Petitioner filed a petition for the return of her child under the Hague Convention on the Civil Aspects of International Child Abduction, Oct. 25, 1980, T.I.A.S. No. 11,670, 19 I.L.M. 1501, as implemented by the International Child Abduction Remedies Act (ICARA), 22 U.S.C. 9001 et seq. The district court denied the petition. The court concluded that the district court did not clearly err in finding that respondent was "more believable" and petitioner did not challenge that determination. The court agreed with the district court that the preponderance of the evidence demonstrated that petitioner consented to respondent's removal of the child to the United States. CBF, appellants and award-creditors, challenged the district court's two judgments dismissing CBF's initial action to enforce and subsequent action to confirm a foreign arbitral award against appellees as alter-egos of the then defunct award-debtor. The court granted appellees' petition for rehearing for the limited purpose of vacating the original decision and simultaneously issuing this amended decision to correct the court's instructions to the district court with regards to the applicable law for an enforcement action at Section I.c., infra. In No. 15‐1133, the court held that the district court both (1) erred in determining that the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards and Chapter 2 of the Federal Arbitration Act, 9 U.S.C. 201 et seq., require appellants to seek confirmation of a foreign arbitral award before the award may be enforced by a United States District Court and (2) erred in holding that appellants' fraud claims should be dismissed prior to discovery on the ground of issue preclusion as issue preclusion was an equitable doctrine and appellants plausibly alleged that appellees engaged in fraud. Therefore, the court vacated the judgment and remanded for further proceedings. Plaintiff filed suit against defendants, alleging that they forced her to provide labor in violation of the Trafficking Victims Protection Act of 2000 (TVPA), 18 U.S.C. 1589. Specifically, plaintiff alleged six claims of involuntary servitude and illegal trafficking stemming from her work as a live-in housemaid to defendants. The district court granted summary judgment to defendants. Drawing all reasonable inferences in favor of plaintiff, the court agreed with the district court's determination that plaintiff's evidence was insufficient to satisfy the requirements of the forced labor statute and that defendants were entitled to summary judgment as a matter of law. In this case, plaintiff failed to develop sufficient evidence upon which a jury could reasonably conclude that defendants knowingly forced or coerced her to come to the United States, or to remain in their employ against her will, by means of serious psychological harm or abuse of law or legal process, when she otherwise would have left and returned to her home country of Kenya. This case involved a contract dispute arising out of the lease of telecommunications equipment by GDG to the Government of Belize. In this appeal, the Government challenged the district court's denial of its motion to dismiss. The court concluded that the Government waived its sovereign immunity. In this case, the Government claimed that the express waiver of sovereign immunity contained in the contract was ineffectual because its Minister of Budget Management, who negotiated and signed the contract on its behalf, lacked the authority to waive sovereign immunity. The court explained that, despite the Minister's claimed lack of authority to bind Belize, the Government ratified the actions by fully performing its contract obligations during the lease term and paying approximately $13.5 million in forty separate payments over a period of nearly six years and spanning two different administrations. Therefore, the court reasoned that the Government's conduct intended it to be bound by the contract and affirmed the district court's denial of the Government's motion to dismiss. Father initiated proceedings for the return of his two young daughters under the Hague Convention on the Civil Aspects of International Child Abduction, Oct. 25, 1980, T.I.A.S. No. 11,670, 1343 U.N.T.S. 89. The children resided in Mexico City until Mother took them on vacation and wrongfully detained them in the United States. The district court ordered the children returned to Mexico. The court affirmed the district court's denial of Father's post-judgment motions, concluding that the courts in Mexico, the state of the children's habitual residence, are the appropriate forum to grant relief to address his concerns. The court explained that, subject only to the confines of Mexican law, Mexican courts are free to grant Father full custody over the children and to prohibit or restrict their international travel, and there is no international legal void that requires the Convention’s intervention. In regard to Mother's challenge of the district court's denial of her motion to vacate the Original Return Order, the arrest warrant for Mother's arrest does not establish clear and convincing evidence of a grave risk of harm to the children. Plaintiff, who had endured many hardships in 2003 while trying to leave Baghdad, alleged, in a purported class action, that former officials of the President George W. Bush administration engaged in the war against Iraq in violation of the Alien Tort Statute, 28 U.S.C. 1350. The district court held that plaintiff had not exhausted her administrative remedies as required by the Federal Tort Claims Act. The Ninth Circuit affirmed the dismissal, holding that the individual defendants were entitled to official immunity under the Westfall Act, 28 U.S.C. 2679(d)(1), which accords federal employees immunity from common-law tort claims for acts undertaken in the course of their official duties. The court upheld the Attorney General’s scope certification (determining that the employees were acting within the scope of their employment so that the action was one against the United States). The court rejected an argument that defendants could not be immune under the Westfall Act because plaintiff alleged violations of a jus cogens norm of international law from which no derogation is permitted and which can be modified only by a subsequent norm of general international law.
